By making a booking, you are entering into an agreement between you as the tenant and the owner of the luxury villas (“ISTRIA NUOVA d.o.o.”). ISTRIA NUOVA acts as the villa owner. The booking of holiday homes shall always be subject to these booking conditions, which, together with “Worth Knowing”? and the rental voucher, form the rental agreement between you and the villa owner. Travel agents, websites, and other booking agents cannot enter into agreements that differ from ISTRIA NUOVA’s booking conditions or the information in the relevant catalog or on the internet. The tenant shall acquaint themselves with regard to any services set out in ISTRIA NUOVA’s booking conditions or on the internet through “BOOK NOW”. Any amendments to the rental agreement shall only be valid if they appear in writing.
Prior to the start of the tenant’s stay in the luxury villa, the tenant will receive rental documents containing travel directions and instructions on how to find the keys to the luxury villa. On the day of the booking of the luxury villa, the lead tenant must be at least 18 years old. For traveling parties consisting of youth groups, the tenant of the luxury villas must be 18 years old on the day the luxury villa is booked.
The rental documents contain information on the time on which the holiday home is ready for arrival. The key can usually be collected at a time later than that stated on the rental documents as long as an agreement about later collection has been made in advance and the tenant pays an agreed fee. The luxury villa must always be vacated by no later than 10 a.m. on the day of departure. The key will only be handed out if the full rent has been paid in accordance with the booking conditions and upon presentation of the original rental voucher and a form of photo identification.
2.1 The size and use of the luxury villa: Unless otherwise agreed with Istria Nuova d.o.o, the luxury villa may not be used for any purpose other than a holiday. The stated square meters of the villa have been calculated based on the outside measurements of the base.
2.2 Number of guests: At any time, the villa and the property belonging to it may be occupied by no more than the number of people stated in the brochure, on our website, and in the rental agreement. That number includes children regardless of their age. The only exceptions are the option of bringing one additional child (less than 4 years old) without additional payment. This option should be chosen at the time of booking and will also appear on the villa’s information (‘Villas’ tab) which can be read on our website. If the villa or the property is being occupied by more people than the maximum number allowed, the villa owner which is Istria Nuova d.o.o. shall be entitled to request the additional people to vacate the villa without notice. If the tenant does not comply with this request within 4 hours, the villa owner shall be entitled to terminate the rental agreement with immediate effect and to oblige all occupants to vacate the holiday home without further notice and with no refund. Istria Nuova primarily acts as an owner to rent their villas to families and couples. Youth groups, meaning at least 6 persons who are primarily under 18 year of age, are naturally welcome as well, but such groups must notify ISTRIA NUOVA that they are a youth group at the time of booking. ISTRIA NUOVA shall be entitled to reject a group if such notification is not made in good time before the start of the tenant’s stay in the villas.
2.3 Tents and caravans: It is prohibited to pitch tents or have caravans or similar structures on or by the villa’s property. The ISTRIA NUOVA shall be entitled to demand these be removed immediately. If the tenant does not comply with such instructions immediately, the villa owner shall be entitled to terminate the rental agreement with immediate effect and to oblige all occupants to vacate the villa without further notice and with no refund of the rent.
2.4 Pets and allergies: for now in the villas the pets are not allowed. However, neither the ISTRIA NUOVA can guarantee that there have not been any pets in the house on prior occasions. Neither the ISTRIA NUOVA assumes any responsibility for the tenant’s allergic reactions as a result of pets having been in any of the holiday homes.
2.5 Noise: Occasionally tenants may unexpectedly experience noise from construction sites, traffic, etc. Neither the ISTRIA NUOVA can be held accountable for unexpected noise.
2.6 Internet: Internet connection/broadband is offered in several different ways, for example, wifi. Internet is an extra service which the homeowner supplies and because of the challenges that can be presented by inadequate coverage in the area where the holiday home is located and variable data volumes and speed, ISTRIA NUOVA cannot be held responsible for a bad signal, overloaded antenna, cable problems or other issues with coverage. Internet access may only be used by adults and the use of the internet shall be in accordance with relevant laws.
2.7 Smoking: Smoking is not permitted in the villas unless otherwise specifically stated. This does not however mean that there has never been any smoking in the villas.
2.8 Swimming pools: For safety reasons, the tenant shall follow any instructions from the ISTRIA NUOVA relating to the use of a swimming pool. The tenant shall be responsible for any use of the swimming pool. Children under the age of 16 are not allowed around the pool area or in the pool itself without the supervision of an adult.
3.1. ISTRIA NUOVA accepts payment via the Online Payment System. We accept payment by the following methods: Visa, MasterCard, American Express, Maestro, direct deposit into our bank account, pay pal, and bank transfer.
Istria Nuova uses WSPAY service for online authorization of credit and debit cards MasterCard, Maestro, Visa, American Express, Diners, JCB, and Discover.
Istria Nuova takes credit card data security very seriously. For that reason, we use WSPAY to securely handle credit card information. WSPAY is a Validated Level 1 PCI DSS Compliant Service Provider.
3.2. ISTRIA NUOVA accepts payment in cryptocurrency. We accept payment by the following methods: Bitcoin, Ethereum, Litecoin, Dash, and + 50 altcoins.
3.3. When using the ISTRIA NUOVA Online Payment System, your Booking is split into two portions – an advance payment in the amount of 30% of the agreed accommodation price is required at the reservation, after which the reservation is confirmed, the contract with ISTRIA NUOVA is concluded and these General conditions, which make a constituent part of the villa rental contract are accepted. After the completion of the reservation process and payment, ISTRIA NUOVA shall send a written reservation confirmation by email, which contains all the necessary information about the accommodation, and along with these General conditions it represents a Rental contract concluded with ISTRIA NUOVA. The rental contract is considered concluded at the moment when ISTRIA NUOVA receives the paid advance amount. In case that the payment is not made on the same day from the reservation day, the Rental contract is deemed terminated, and ISTRIA NUOVA is authorized to conclude a new Rental contract with another guest, without special notice to the guest. The remaining balance of 70% must be transferred 30 days before the check-in date.
You may pay both portions (the full amount) in Euros, American Dollars or Pounds up-front or pay the deposit initially and subsequently pay the remaining balance. If you have a different currency on your credit card conversion to Euros, American Dollars or Pounds will be made by your credit card company.
4.1. A concluded rental contract can be canceled only in writing (by email). The cancellation is effective only from the day when ISTRIA NUOVA received such a cancellation notice and only under the conditions from this Clause.
4.2. If the reservation amount is paid via Bank transfer- In case of cancellation of the Rental contract all the received payments until the cancellation date shall be retained, and the guest is not entitled to their return. The following cancellation conditions will be applied: Deposit of 30% is non-refundable at any condition unless it is agreed by ISTRIA NUOVA D.O.O. (LTD).
4.3. If the reservation deposit or amount is paid via credit card- In case of cancellation of the Rental contract 42 days or more before arrival, all the received payments will be entitled to their return.
4.4. In case that the guest can find another guest as his substitute in the same period, for the same price and under the same conditions, ISTRIA NUOVA shall transfer immediately after a written receipt of all necessary data about the new guest the Rental contract to a new guest, and it shall send him/her a written confirmation about it. The already received accommodation price sums shall be retained by ISTRIA ISTRIA NUOVA after the transferred contract, and the new guest is obliged to pay the rest up to the total accommodation price depending on the previously selected payment method which makes an integral part of the contract.
4.5. In case that the object is not available for the rent due to the Act of God such as earthquake, flood, fire, etc. ISTRIA NUOVA is not liable for the canceled reservations.

5.1. When you book: Given the impact of COVID-19 on how we work, socialize, and travel, we are forced to adapt our reservation change and cancellation policy.
For guests making a new reservation in Istria Nuova’s villas for arrivals after 1 September 2020, Istria Nuova is unable to allow reservation changes or cancellations free of charge. With the WHO’s declaration on 11 March 2020 of the COVID-19 outbreak as a pandemic, its eventual consequence on travel can no longer be considered as unforeseen or unexpected by consumers. Please see our terms and conditions of booking for information on payment terms and cancellations.
5.2. During your stay: Daily, we are working to ensure that they meet the latest guidance from the CDC and WHO on hygiene and cleaning. The health and safety measures in our villas aim to address a broad spectrum of viruses, including COVID-19, and cover everything from handwashing hygiene and cleaning product specifications to the villa and common area cleaning procedures.
6.1. Best-price guarantee ISTRIA NUOVA guarantees to its guests that on the official pages of the agency www.istrianuova.com the accommodation prices for individual offered villas are the lowest, i.e. that the same villa cannot be found in advertisements at the lower prices than ours. In case that the guest gets on some other web pages, offers, agency catalogs, etc. a more favorable offer for the same villa in the same period, under the same conditions and in the same currency before the reservation than the price which offers ISTRIA NUOVA and delivers evidence about it to the address of ISTRIA NUOVA, the agency guarantees a rental contract conclusion for the same villa in the same period and under the same conditions with an additional 10% (ten percent) discount on the lower offered evidenced price. The best-price guarantee is not valid if the price difference is a consequence of the tax or stamp duty increase or significant changes in the exchange rate. It is also not applicable if the lower prices on other web pages are not up-to-date, and it is not possible to make a reservation at such prices, and in case of special last-minute offers. The lowest-price guarantee is applicable only at the moment of reservation and it cannot be applied later or after the already carried out and paid reservation.
7.1. The tenant shall treat the rented premises in a responsible manner, and the tenant must return the rented premises in the same condition as they were received. The tenant shall be liable to the homeowner for any damage to the holiday home and/or its inventory/furniture/appliances or facilities inflicted during the rental period by the tenant or others who were given access to the rented holiday home by the tenant.
7.2. A damage deposit of €1000.00 is payable on the day of check-in. The deposit does not apply to the rental fee. The security deposit will be refunded in full on the day of departure provided there is no loss or damage to the property. In the event that damages exceed the amount of the deposit, the villa owner will forfeit their deposit and it will be charged with the amount of the damages; a detailed invoice of all charges will be supplied.
7.3. Any loss or damage to ISTRIA NUOVA, properties can be deducted from your deposit including the following: the number of guests exceeds that which is listed on the rental contract, replacements and repairs that are considered outside normal wear and tear, conditions that require excessive cleaning/laundry or rearranging of furniture that has been moved, replacement of missing items from the unit, soiling of towels, linens and carpets, costs to replace keys and misuse of items belonging to the property.
